Terms of use
Last updated [DATE]
These terms apply to everyone who uses Pompla. By searching, booking or otherwise using the site you agree to them, so it's worth reading before you pay for anything.
Pompla is operated by [LEGAL ENTITY NAME], registered at [REGISTERED ADDRESS], GSTIN [GSTIN]. In these terms, "we", "us" and "Pompla" mean that entity. "You" means the person using the site or making a booking.
1. What Pompla actually is
Pompla is a marketplace. We show you fixed-departure group trips run by independent tour operators, let you compare them by date, and let you book and pay in one place.
We are not the tour operator. The trip itself — transport, accommodation, guides, meals, safety, and everything that happens on the ground — is provided by the operator listed on the trip page, under their own terms. Your booking creates a contract between you and that operator. Pompla's role is to list their trips, take your payment, and hold that money until the trip begins.
We say this plainly because it decides who you deal with when something goes wrong. For anything about how a trip is run, the operator is responsible. For anything about booking, payment or refunds, come to us.
2. Who can book
You must be 18 or older to make a booking. If you're booking for other people, you're confirming that you have their permission to share their details with us and the operator, and that you'll pass on what we send you — including the joining instructions and the cancellation terms.
Some trips carry their own age, fitness or medical requirements set by the operator. These are shown on the trip page. It's your responsibility to read them and to be honest about whether they apply to you — a trek at altitude is not a safe place to discover a condition you didn't mention.
3. Booking and payment
A booking is confirmed only when we have received full payment and sent you a written confirmation. Until that confirmation reaches you, no seat is held for you, however far through the payment flow you got.
Prices are shown in Indian Rupees and include everything the operator charges for the trip as listed. We don't add a booking fee or a convenience fee at checkout.
Payments are processed by our payment gateway. We don't see or store your card or bank details.
We hold your payment until the start date of your trip, and pay the operator afterwards. This is deliberate: it means that if a trip is cancelled before it starts, the money is still with us and we can return it to you directly.
4. Prices, seats and mistakes
Operators set their own prices and seat counts, and can change them for future departures. The price you paid at the time of booking is the price of your booking — a later change doesn't affect a confirmed booking in either direction.
Very occasionally a listing may show a wrong price, date or seat count because of an error by us or the operator. If that happens we'll tell you as soon as we notice, and you can either accept the corrected booking or take a full refund. We won't hold you to an obvious error, and we won't quietly charge you the difference.
5. Changes and cancellations
If you want to cancel, our cancellation policy explains the notice periods and what you get back, and our refund policy explains how and when the money reaches you.
Operators can also cancel or reschedule a departure — most often because too few people booked, or because of weather, road closures or local restrictions. If a trip is cancelled by the operator, you are entitled to a full refund of everything you paid to us, regardless of how close to departure it happens. You can instead move to another departure if one suits you.
Operators may make small changes to an itinerary on the ground for safety or practical reasons. That's normal in mountain travel and isn't a cancellation.
6. What we're responsible for, and what we're not
We're responsible for running this site honestly: showing accurate listings as given to us by operators, taking your payment securely, holding it as described, confirming your booking, and processing refunds we owe you.
We're not responsible for how an operator runs their trip, for injury, loss or damage occurring during a trip, or for delays and cancellations caused by weather, road conditions, strikes, government restrictions or other things outside anyone's control.
Where we are liable to you, our liability is limited to the amount you paid us for the booking in question. Nothing in these terms limits any liability that can't be limited under Indian law, including for fraud or for death or personal injury caused by our negligence.
7. Travel insurance
We strongly recommend travel insurance covering medical treatment, evacuation and cancellation, particularly for treks and high-altitude trips. Some operators require it. It is not included in the trip price unless the trip page explicitly says so.
8. Your conduct on a trip
Operators may remove someone from a trip whose behaviour is unsafe, or seriously disruptive to other travellers. If that happens you won't be refunded, and getting home is your own responsibility. This is rare, and it exists to protect other people on the trip.
9. Your information
To make a booking we collect your name, email, phone number and the details of anyone travelling with you, and we share what's necessary with the operator running your trip so they can run it. We don't sell your data.
Full detail is in our [PRIVACY POLICY — still to be written].
10. Content on this site
The Pompla name, logo, site design and written content belong to us. Trip descriptions, itineraries and photographs are supplied by operators and remain theirs. Don't copy or republish any of it without permission.
11. Changes to these terms
We may update these terms as the service develops. The version that applies to your booking is the one published when you booked, so a later change won't be applied retrospectively to a booking you've already made.
12. Governing law and disputes
These terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts of [CITY].
Before anything reaches a court, please write to us — most problems are a misunderstanding that a conversation fixes faster than a legal process.
13. Reaching us
Email hello@pompla.com. We reply to booking and refund questions within [X] working days.
Before publishing: replace every highlighted placeholder with your real details, and have a lawyer read this through. It's written to be honest and readable rather than to be a substitute for legal advice — and a payment gateway, a consumer complaint or a dispute with an operator will all test the exact wording.
